“There is prima facie case, according to Court of Appeal” – K.Ramalingam

Kuala Lumpur – The following is the full text of the press statement issued by K.Ramalingam, one of the appellants in the MIC-RoS Conspiracy case, as posted in his facebook. The Court of Appeal, in allowing the appeal by Ramalingam and others, today ordered for a full trial of the case.

“Today, Court of Appeal unanimously allowed the five appeals by K.Ramalingam and 7 others against the decision of High Court to strikeout their claims against the Registrar of Societies, Datuk Seri Dr.Subramaniam and the others.

The Court of Appeal found the High Court erred in summarily striking out the claim to set aside the High Court’s previous judgements on the two Judicial Review applications challenging the decisions of the ROS to nullify the 2013 MIC elections and to order for re-elections.

The Court of Appeal found that there was a prima facie case of fraud and collusion and that the defendants have a case to answer and can only be determined at the full trial. The Court of Appeal in allowing the appeals to set aside the decision of High Court to strike out the claim and ordered the case to proceed for full trial before a different High Court judge. The Court of Appeal also awarded the appellants costs of RM 10,000.00 for each of the five appeals”
