NAIROBI, May 28 – Four Kenyan businessmen have sued the country’s former president, Daniel arap Moi, over ownership of 16 acres (about 6.475 hectares) of land in Nairobi County.
The four, led by Simon Laboso, are accusing Moi of illegally transferring ownership of the land which they claim to own to Tulip Properties Limited, a company they allege is linked to the former president.
The four petitioners — Mohamed Nur, Simon Laboso, MacDonald Maraka and Noor Mohamed Hassan — allege that Moi was never allocated the land by the Commissioner of Lands and had no jurisdiction to transfer the land.
According to them, the land was acquired as a consequent of abuse of public office and impunity. They now want the court to order Tulip Properties not to develop the land and declare that the transfer to Tulip was illegal.
The company is said to have paid 25 million shillings (about US$294,000) to Moi to buy the land in a civil suit against the four. Tulip sued the four businessmen in 2004 for trespassing on the land.
