KUALA LUMPUR, Aug 24- The Attorney-General’s Chambers is to appeal to the Federal Court against the Court of Appeal’s acquittal and discharge of two police special action unit personnel convicted by a High Court of murdering Mongolian Altantuya Shaaribuu.
Attorney-General Tan Sri Abdul Gani Patail noted that non-directions by the trial judge on issues raised by the appellants in his judgment which amounted to misdirections and the non-calling of one DSP Musa Hj Safri formed the main grounds of the setting aside of the conviction and sentence.
“While respecting the Court of Appeal, the Attorney-General’s Chambers for the prosecution is dissatisfied with the decision as non-direction or misdirection by the trial court is not the fault of the prosecution,” he said in a statement yesterday.
“As far as DSP Musa Hj Safri (is concerned), we maintained that his testimony had no relevance at all as the whole narrative of the prosecution’s case had been unfolded in the trial.
“Hence, an appeal to the Federal Court will be filed,” Abdul Gani said in the statement which did not mention when this would be done.
It noted that Chief Inspector Azilah Hadri, 37, and Corporal Sirul Azhar Umar, 42, were convicted and sentenced to death by hanging by the High Court sitting in Shah Alam on April 9, 2009, for the murder of Altantuya between Oct 19 and 20, 2006.
Their appeals were allowed by the Court of Appeal where the conviction and sentence were set aside.
