Palanivel faction’s appeal to Federal Court for leave fixed on 21st October!

palanivel-subramaniam-MICPutra Jaya – MIC sources confirmed that former MIC President Dato Seri G.Palanivel faction’s application for leave of appeal to Federal Court on the Judicial Review case against Registrar of Societies (RoS) is now fixed on 21st of October 2015. The case management of the matter was heard today.

Lawyer Datuk V.Manoharan appeared for one of the appellants Tan Sri S.Balakrishnan while Palanivel was represented by lawyer Dayalan.

Meanwhile, MIC sources pointed out that the MIC General Assembly is scheduled to take place on the 25th of October 2015, and on the same day the party’s re-election for the posts of Deputy President, 3 Vice-Presidents and 23 Central Working Committee members, will also take place.

On 21st October, the Federal Court will hear whether leave should be granted for the appeal. If leave is rejected then it will mean that Palanivel faction’s court battles against the leadership of Dr S.Subramaniam and the RoS comes to an end. Such a decision would also put the final nail on the hopes of Palanivel and four others to return to the party as members or as office-bearers.

Even if the leave is granted, the Federal will proceed to hear substantive legal points of the case at a later date before arriving at the final decision.

Some of the Lawyers, following the MIC-RoS legal tussle are of the opinion that by the time Federal Court hears and delivers its final judgment (even if it favours Palanivel’s faction) the process of MIC’s re-election would be completed and thereafter any decision of the Federal Court will only have an academic effect, as the elections would be over with the new office-bearers having been elected by then.
