Kuala Lumpur, July 30 – Sources close to former MIC President Dato Seri G.Palanivel said that some of his key supporters are preparing to file a string of court cases against MIC in view of the forthcoming MIC Presidential election.
Nominations for MIC Presidential election has been fixed on 21st of August and lawyers following the legal tussles in MIC point out that Palanivel’s faction has until that date to prove if they have any valid legal grounds for any of their claims.
Otherwise, once the new President is elected on the 21st of August then the political game will be over for them because thereafter it would be legally a mammoth task to get an order to declare the presidential election null and void. Dr Subramaniam is widely expected to be unanimously elected as the 9th President of MIC when nominations close on 21st of August.
Cases expected to be filed today
Palanivel’s sources said that some of their supporters are in KL High Court today morning to file the cases.
The sources also said one case would involve seeking reinstatement of MIC membership of 5 leaders namely G.Palanivel, S.Balakrishnan, S.Sothinathan, Prakash Rao and K.Ramalingam and to challenge the interpretation of Section 91 of the MIC Constitution.
MIC 2009 Interim CWC interpreted Section 91 of MIC Constitution and declared that the above 5 ceased to be members for going to court without the approval of CWC. The Registrar of Societies (RoS) also accepted the interpretation and declared Dato Seri Dr S.Subramaniam as the Acting President of MIC.
Another case would involve seeking an injunction against the MIC Presidential nomination fixed for 21st of August, Palanivel’s sources further said.
Palanivel and others are also expected to file an appeal to Federal Court against the Court of Appeal decision on July 13 which rejected the judicial review application filed by them. However, they will have to get leave of Federal Court first before proceeding with the proper appeal.
MIC sources revealed that with the removal of Palanivel as Minister, his faction has lost steam in their political battle against Dr Subra’s faction and the contemplated court cases are last minute desperate attempts to establish their rights and to stop the MIC Presidential election.
