“2013 CWC is not validated by Court ruling” – Saravanan clarifies

unnamedKuala Lumpur, May 13 – In a press conference called today MIC Vice President Datuk M.Saravanan explained that the court will be hearing submissions from all parties on the 27th of May and that only an interim stay order has been granted against 2009 CWC until 27th of May.

He further clarified that this does not mean that the court has validated the “2013 CWC” or cancelled the directives of the RoS. The court has merely stayed the implementation of the RoS directives until 27th of May. The Court has also ruled that the 2009 CWC should not hold meetings or take decisions but in fact the lawyers for “2009 CWC” have already given assurances that their clients would not resort to any activities until the final disposal of the case.

“Last night about 11 pm I received sms messages purportedly sent to all MIC Branch Chairmen, stating that 2013 CWC meeting will be called by the President and that all the letters issued by the RoS have been suspended until next hearing. Since then I have received several phone calls from concerned MIC Branch Chairmen and that is why I am calling this press conference to clarify” Saravanan said.

Saravan also pointed out that the interim stay order granted by the court in fact benefits the party and all the stakeholders in this matter because if the RoS directives are not carried out by the stated dateline then party faced the possibility of a de-registration.

“With the court ruling yesterday it has in fact given a reprieve to the MIC and its members as the party would not face de-registration until the court hands over the final judgment”  Saravanan said.

Letter sent out by Lawyers

Saravanan also confirmed that his lawyers have sent a letter to the Plaintiff Palanivel’s lawyers today reminding them that the true intention of the order is to preserve the status quo and that the Plaintiffs should not place a wider meaning to the order.

The letter sent out by the lawyers also stated that the plaintiffs should not hold meetings of the 2013 CWC or carry out activities inconsistent with the spirit and intention of the orders placed by the court.

“On the 27th of May, if the court orders that the ROS decisions are cancelled we will accept the decision. This is not our problem as we are not the complainants. It is the problem of the RoS as those letters were issued by the RoS” clarified Saravanan.

Senator Dato Jaspal Singh who attended the press conference with Saravanan also explained to the press about the background of the case and the latest developments.
