Palanivel launches another legal battle – set to appeal against the decision!

Kuala Lumpur, June 15 – Undeterred by the KL High Court decision today, MIC President Datuk Seri G.Palanivel is making another attempt to continue his legal tussle with ROS – he is appealing against the decision.

Palanivel announced his decision to challenge the High Court ruling today and also declared that he is still the rightful President and claimed he has appointed Datuk S.Sothinathan as the party’s Secretary General. His actions and announcements are expected to put the party in another turmoil.

“The High Court today has decided not to allow the judicial review applications filed by Malaysian Indian Congress (MIC) and 3 others, as mandated by the majority of the Central Working Committee members, against the Registrar of Societies. The Applicants have decided to appeal to the Court of Appeal against the said decision of the High Court which will be filed on a very urgent basis. Upon the advise of the lawyers, we also will be filing for an order of stay of the RoS directives in their 3 letters.

Subject to the outcome of the stay application, any meeting of the Central Working Committee (CWC), be it 2009 CWC or the 2013 CWC, shall be called by me as the President as provided for in the Constitution. I will direct the Secretary General to issue the appropriate notice for the CWC meeting in accordance to the MIC Constitution.

In this regard, I had, on 9 February 2015, informed the Registrar of Societies of my decision to appoint Dato’ S Sothinathan as the Secretary-General of MIC and I further issued a press statement to that effect. No one can question my sole and absolute rights under Articles 46.5 and 49 of the MIC Constitution in appointing the Secretary General.

It has been brought to my attention that a purported Notice of Emergency Meeting of the Interim CWC of MIC dated 15 June 2015 had been issued purportedly by the “Elected Members of the Central Working Committee Term 2009-2013”. The meeting is fixed on 16 June 2015 at 12.30 pm.

Therefore, the purported Notice of Emergency Meeting of the Interim CWC of MIC is illegal, null and void. Thus, any meeting held pursuant to such notice shall also be illegal, null and void. Any other meetings similarly called shall also be invalid.

Thus, pursuant to the Presidential powers conferred upon me in the MIC Constitution, stern action will be taken by me against all those responsible in calling for such illegal meeting and those attending.”
