NEW DELHI, June 9 – The absence of the Malaysian woman who was drugged and raped in Jaipur, Rajasthan will not impact the prosecution of the accused as enough evidence have been collected to nail him in the case.

The victim’s absence would not have any impact on the prosecution, as police had recorded her statement before a magistrate under Section 164 of the CrPC (recording of confessions and statements under the Code of Criminal Procedure) before she left for Malaysia, according to a Times of India news report, quoting an unnamed police officer.

The 30-year-old victim had related the incident before the magistrate in exactly the same way she did before the police, said the police officer.

According to the news report, police found semen stains in the car where the victim was raped and had taken into custody the country-made gun that the accused allegedly used to threaten her.

A soft drink bottle in which the accused had mixed some substance to drug her had also been recovered. The medical and forensic reports were also awaited, said the English daily.

Police said the victim could not tell the exact location where she was raped as the accused drove her around an area completely unknown to her.

Police will try to confirm this from the accused, who is currently in police remand until Monday.

According to the police officer, going by the evidence gathered by police, it was a premeditated rape.

“Even before the accused took the victim to the hotel to have dinner with her, he had intended to drug and rape her.

“We have found several evidence that undoubtedly suggest that he raped the woman. The fact that he was carrying a gun also consolidates our theory of premeditation,” the police officer said.
